Afrikaner pensioner Lukas Labuschagne 72, kicked to death by four well-dressed black men in Mercedes, alongside a Benoni road
2014-05-31 Reported by Pieter-Louis Myburgh. 72-year-old retired building contractor Lukas Labuschagne was kicked to death by 4 angry black males in a Mercedes.
The old Afrikaner was driving his bakkie to take his son Adriaan and two of their workers around on jobs because Adriaan’s vehicle was being serviced.
er. The group was confronted by four black males who were driving their Mercedes recklessly, and at high speed through the traffic.
The driver of the Mercedes then rode Labuschagne’s bumper and tried to push them all of the road – despite the fact that the two workers were seated on the back.
Lukas refused to give way. The Mercedes pulled in front of them, pulled to a stop in front of the bakkie. and the four ‘neatly dressed males’ climbed out and stormed
towards the group in the bakkie. Adriaan and his dad climbed from the bakkie to find out why the men had blocked them.
They were attacked at once: Adriaan was hit in the face and kicked in the ribs. “I could defend myself against two of the men.
I saw my dad fall to the pavement after the other two attacked him. One of his workers said one of them had kicked Mr Labuschagne senior in the stomach.
He saw his father lying in a puddle of his own blood and when he tried to help his dad he was kicked in the ribs.
The old Afrikaner had been treated for an aneurism in the stomach seven years earlier and Adriaan believes the kick was so fierce that his dad sustained internal injuries and bleeding.
He drowned in his own blood. “It was terrible. Blood came pouring from his mouth and nose. His dentures floated in his blood.’
The four heroes of the revolution then climbed back into their Mercedes and drove off, leaving an old man dead on the pavement.
SAPS lt Nomsa Sekele of the Benoni cops said they hadn’t arrested anyone because ‘the men were already gone when the police showed up.’
She didn’t say anything about trying to trace their Mercedes or alert the rest of the police force to keep a lookout for the men.
Labuschagne ‘s funeral takes place in Boksburg on Friday.
A “Justice Project South Africa spokesman blamed the motorists for the death: saying that ‘they should not under any circumstances get out of their cars no matter how angry THEY ARE AGAINST OTHER DRIVERS.’
“This can only end by you ‘winning the fight’ and get into a lot of trouble, or get badly injured.”

‘A white vehicle sat on my tail from Meerensee, so close I could not see the front of his car.

Massive firearms scandal unfolds at Johannesburg Magistrate’s Court: corrupt policemen supplying arms and ammo to criminal gangs
Graeme Hosken 2014-06-04
Thousands of weapons were surrendered to the police during the firearms amnesty of 2009 and were earmarked for destruction.
On Monday last week, police raided the house of elderly Ukrainian couple Emma Shmukler-Tishko, 65, and her husband Mark, 62, and seized 112 assault rifles, handguns, commercial explosives and detonators stored in a backroom.
Prosecutor Talita Louw told the court yesterday that among the recovered weapons were guns that should have been destroyed during the amnesty period.
Louw said that an R1 rifle handed in at the Roodepoort police station, in April 2010, during the amnesty, was among the weapons confiscated from at the couple’s house in Norwood, Johannesburg.
“In May, the same rifle was officially taken out of the storeroom for destruction. It is not known how the same firearm was found in the possession of the applicants,” she said.
Louw said investigators were checking the serial numbers of other firearms handed in at police stations across the country.
“There are several firearms that have visible serial numbers but are not reflected as stolen on the firearm registration system . they are still registered and have ownership.”
She said many of the other confiscated arms were, according to police records, state-registered.
“The only inference that one can make is that there is more to this case than meets the eye.
”Investigations are under way to determine how these firearms left the custody of the police.”
One of the accused, Emma Shmukler-Tishko, who suffers from multiple sclerosis, was granted R5000 bail.
She, together with her husband, and Malawian domestic worker Endi Nkhoma, 26, face charges of dealing in, and possession of, prohibited and unlicensed firearms, and dealing in, and possession of, ammunition and explosives.
The latest revelation has enraged Martin Hood, of the SA Gunowners’ Association.
Hood said it was accepted that police stations were “porous” and that exhibits were stolen or sold from police stations.
“It is obvious that the police do not have proper control of firearms in their storerooms.
“Are police corrupt in the handling of firearms? – totally,” said Hood.
He revealed that a pistol, handed in for destruction at Tugela Ferry police station, in KwaZulu-Natal, was used in the killing of a Gauteng Spar supermarket manager.
Hawks spokesman Captain Paul Ramaloko said the investigation of the Norwood arms cache had been widened “after certain facts came to light”.
“If it’s proved that these weapons were meant to be destroyed as part of the firearms amnesty, we will hold [the police officers involved] accountable.
Wherever the investigation leads us, we will go,” he said.
Investigators are trying to establish what crimes had been committed with the seized weapons.
A policeman involved in the registration of firearms said: “The police allegedly behind this could, if found guilty, be responsible for murder or other violent crimes.
“There are meant to be strict controls around police exhibit [stores] and strongrooms where weapons handed in or recovered are kept.”
He said that only police station commanders and strongroom clerks were allowed access to the guns in their keeping.
“There is a critical failure around the safeguarding of the strongrooms.
“People who handed in guns for destruction did so thinking the police would destroy them but these promises have not been kept.”
He said weapons earmarked for destruction had to be destroyed.
“There is no way around this,” the police source said.

Racial discrimination: SAPoliceService refuses post of auditor of secret crime intelligence fund to whistle-blower col. Kobus Roos despite court order
SAPS refuses post of auditor of secret fund of crime-intelligence unit to whistle-blower colonel Kobus Roos — despite Labour Court order: Solidarity:
Solidarity trade union reports that the SAPS refuses to have colonel Kobus Roos conduct another audit of their crime-intelligence unit’s secret funds — after he revealed fraud and corruption during an earlier audit. The SAPS claims in a letter to Solidarity that ‘they will not grant access to Colonel Roos to the secret fund again, because ‘there are no vacant internal auditor’s post at Roos’ salar level at that unit.’ They do have an open post for Roos in an internal audit-departement at the SAPS headquarters in Pretoria – and demand that he must report for work next week.
This was the SAPS response six weeks after the Labour Court in Johannesburg ordered the SAPS to pay compensation in the amount of R156,000 to colonel Roos because lt-genl. Richard Mdluli, the now suspected head of crime-intelligence, had ‘transferred him from his post unilaterally.’ Judge Robert LaGrange ruled that the SAPS also had to place Col Roos in a post ‘similar to the one he occupied before his transfer and that if no such post was available in that unit, he had to be given an active job in another forensic-auditing unit of the SAPS. The court also ordered that Colonel Roos had to be given the first available opening to the rank of Brigadier.
Roos lodged his case at the Labour Court after he was given no active work to do for four years after he was transferred to another forensic auditing unit of the SAPS from the crime-intelligence unit. The court was provided with evidence proving that Roos had repeatedly uncovered proof of fraud and corruption with millions of Rands in the secret fund – but was repeatedly ordered by his supervisors to stop his investigations.
Solidarity’s head of fair-labour practices, Dirk Groenewald, said they question the SAPS claim that there was no post in the crime-intelligence unit for Colonel Roos – according to their information there are in fact three internal auditing-posts available at Roos’ salary level. The SAPS denies this and claims that this was an ‘invalid structure’ because it had been introduced by former police-chief Genl Bheki Cele. Solidarity has arranged a meeting with the SAPS about the issue to see what can be done to keep Roos inside the crime-intelligence auditing unit. “Roos now is being punished for a second time thanks to Mdluli’s actions,” Groenewald reportedly said. https://www.facebook.com/116298045063416/photos/a.178568022169751.48293.116298045063416/893012380725308/?type=1&theater — Solidarity: https://www.facebook.com/profile.php?id=195909420099&ref=ts&fref=ts

Prison rape-survivors speak up for the first time
South African Prison Rape Survivors Speak Out for the First Time
December 13, 2014 Henri Le Riche — “South African prisons are notorious the world-over for their endemic sexual abuse.
— Oscar Pistorious, Shrien Dewani, and other high profile accused have leveraged this fact in their efforts to avoid time behind bars.
Despite this, prisoner rape is not well understood by South Africa’s public, and is more likely to be joked about than receive the serious attention it urgently needs.
Prisoners — as the ‘face’ of pervasive violent crime in South Africa — are told that they “deserve to be raped”, and the public accepts prisoner rape as a norm.
This hostility, the stigma attached to victims, and the lack of support provided by authorities, deter survivors from reporting rape.
It causes the dismissal and rejection of those who do speak out, intensifying their trauma.
Afrikaners, people of European decent are a small minority of 4 million, living under a black nationalist regime of 50 million.
— A government where minority rights, human rights, and hate crimes against them are denied by the government, media and left leaning human rights organisations.
Now, three exceptionally brave men, two white and one black, have come forward to share their stories about surviving rape in South Africa’s prisons.
They want to bring it out of the shadows, and are demanding action. Vincent, Francois and Thabo are the first South African survivors of prisoner rape to tell their stories in this way:
“Vincent* tells how he was raped by two gang members in an overcrowded cell in a Western Cape awaiting trial facility. This was his very first sexual experience.
“Vincent asked for help from nurses, wardens, priests, social workers, and even a magistrate who all rejected him and told him to expect this treatment in prison.
“He only received medical attention three years after he was raped when he was sentenced, and then learned he was HIV-positive as a result of the rape.
“Vincent calls on the Department of Correctional Services to stop this from happening to others, and encourages survivors to speak up.
After telling his story, Vincent feels stronger than before, and says “I know I have a purpose in this life.”
— Francois was violently raped twice in an Eastern Cape correctional centre, once at knife-point, and on Valentine’s Day he was raped a second time.
“He reported the rapes to the warders, but never received counseling or support. In despair, Francois attempted suicide.
“After being released, he sued the Department of Correctional Services, and after 10 years he accepted a settlement offer based on the promise that they would take action to stop inmates
from being raped. When nothing changed, Francois decided to tell his story. Francois encourages other survivors to seek help and says “I know I can make it because I’m a survivor.”

Afrikaner Kobus Reyneke’s teeth bashed out by furious black off-duty cop outside Game store, Empangeni Dec 12 2014
Ethel Skye Smit is quoted on Boere Krisis Aksie 13 Dec 2014 12h00noon as writing:
“Yesterday we were the targets of a hate-racist attack enroute to Game in Empangeni. A man stood (and blocked) the middle of the road where we had to turn into.
My friend asked him very nicely “where does he want to drive to?” and then we drove past very calmly and parked.
The next moment that black man climbs half-body into our car and beats my friend repeatedly.
My girlfriend screams and yells at him to stop because ‘there are children in the car’.
Then the black man looks out children straight into their eyes, beats my friend fully in his face and screams:
“All you fucken white boere cunts must die.’
My friend ducks and tries to stop the guy from stomping on his face.
“I lean across him trying to get this black monster from our car. He carries on like an insane person. Tears my friend’s shirt and beats him in the face with his fist.
Broke teeth in his mouth. The children are screaming. I try stopping the man. My girlfriend pushes the children down on the car floor.
And then the black man walks away, fetches a wooden stump to try and hit some more, stands screaming and threatening. People stand around. Nobody helps.
Then he walks away as if he is on vacation, climbs into his car while a womand child openly sit and laugh at us.
I scream to my girlfriend to take the registration number of his car while mister chases off . And guess what? Mr Racist White People Hater turns out

Incitement to Genocide: EFF-leader Malema should be tried; SA pres Jacob Zuma should be impeached warns Dr Greg Stanton of Genocide Watch (video)
‘Incitement to Genocide: Economic Freedom Front leader and MP Julius Malema should be tried, and SA president Jacob Zuma should be impeached: Inciting Genocide is against the law in South Africa and internationally’ warns Dr Greg Stanton, of GenocideWatchNet
speaking at press conference in Pretoria South Africa on 5 December 2014 on his latest fact-finding tour through the country:
Headline of press release on their website:
“Dr Greg Stanton of Genocide Watch Warns of Crime in South Africa
Press Release 5 December 2014 – “At a press conference at the Transvaal Agricultural Union today, Dr. Gregory Stanton, Founding President of Genocide Watch, warned that early warnings of genocide are still deep in South African society, though genocide has not begun.
Dr. Stanton was deeply involved in the Civil Rights Movement in the United States, worked against Apartheid with the United Democratic Front in 1989 – 1990 as a Fulbright Professor of Law at the University of Swaziland, and was the author of the UN Resolutions that created the International Criminal Tribunal for Rwanda in 1994. He was also the legal advisor to the government of Cambodia and drafted the rules for the Khmer Rouge Tribunal. He founded Genocide Watch and the International Alliance to End Genocide in 1999. The Alliance now has fifty member organizations in 24 countries.
Genocide Watch was the first international human rights organization to protest the murders and hate crimes committed against farmers in South Africa.
Since his research trip in July 2012, Dr. Stanton said that hate crimes against Afrikaner farmers have not declined. The murder rate of the whole South African population remains at over 31 per 100,000. The murder rate of farmers, including Afrikaner farmers, is four times as high. The Institute of Security Studies estimated the farm murder rate at 120 per 100,000 in 2013, and the Transvaal Agricultural Union, using verified names of victims, placed the figure at 130 per 100,000 in 2013, one of the highest murder rates in the world.
Since 2007, the South African government has denied and covered up the crisis by not releasing any breakdown of how murders are distributed among ethnic groups in South Africa. American and European governments have remained silent about the problem, reinforcing the campaign of denial.
Several years ago the Marxist racist, Julius Malema, then President of the African National Congress Youth League, revived the singing of the “Shoot the Farmer, Kill the Boer” song, once a revolutionary song, but now an incitement to commit genocide. A South African judge declared that singing of the song is a hate crime and prohibited Malema from singing the “Kill the Boer” song. But then the South African President, Jacob Zuma, sang the song himself, in direct contempt for the judge’s ruling. Malema was later expelled from the ANC over an unrelated conflict with Zuma. He formed his own political party, the EFF, which has continued to promote a Marxist, racist agenda, and Malema was elected to Parliament. Jacob Zuma remains President of South Africa.
Dr. Stanton pointed out that Incitement to Commit Genocide is a crime under both international and South African law. He said that Malema should be put on trial for incitement to commit genocide and Zuma should be impeached, both for violating South African laws against incitement, and for massive corruption.
Dr. Stanton noted that recent studies of the correlation between corruption and atrocities committed by governments show that the relationship is direct. Once in power, corrupt governments cling to power because of the enormous wealth their officials amass. They then persecute, torture, and murder anyone who challenges their grip on power. That downward spiral has begun in South Africa, just as it did in Zimbabwe. In Zimbabwe it resulted in the Gukurahunde genocide against Joshua Nkomo’s Matabele people and Mugabe’s repression of the MDC.
The conviction rate has dropped from 32 percent ten years ago to about 22 percent today. This trend must be reversed. Police must be given education and training so they become competent and motivated crime fighters. An honest, educated, and dedicated police force is the strong arm of justice.
Private security companies should coordinate their systems, use infra-red, aerial and other advanced technology to detect criminals quickly and summon both armed private security companies and police to arrest criminals. Then their cases must be pressed until they are imprisoned.
Criminal gangs from other African countries should be deported.
The South African government must make farm murders a priority. 30,000 commercial farmers supply most of South Africa’s food. South Africa cannot afford to lose their long experience in management. Training people once excluded from management will take several generations, not just a few years.
The first step is for the South African government to admit that farm murders are a serious threat not just to Afrikaner and white farmers, but to all South Africans, and make stopping these crimes a priority.
The second step is to arrest and convict or impeach corrupt political leaders.
The most important step is for South Africans of all ethnic groups to recognize that we are all members of the same race, the human race.
South Africans must reject the cynical manipulation of racial resentments by politicians like Julius Malema and his Marxist racist followers.
South Africa needs effective security for all of its people. Without security, democracy is impossible.

Afrikaner youth Thomas Ferreira's life 'destroyed forever' by Motsaimai Semitjie, the blue-light driver of ANC-politician Humphrey Memezi
Brain-damaged victim Thomas Ferreira’s life was destroyed by reckless ‘blue light driver” Motsaimai Semitjie
Johannesburg – Krugersdorp Magistrate Abdul Khan has described blue light driver, Joseph Motsamai Semitjie, as having ‘destroyed’ the life of teenage victim Thomas Ferreira after hitting him with his car.
“You entered a busy intersection without making sure it was safe to do so… you endangered the lives of others, and a young man’s life was destroyed. As the prosecutor put it, young Ferreira’s life ended that day,” Khan said. Semitjie had been sentenced to five years in jail earlier on Wednesday. On the first charge of reckless or negligent driving, Magistrate Abdul Khan sentenced him to four years behind bars. Half this sentence was suspended for four years. On the other two charges, which relate to his failure to stop at the accident scene and provide help, he was sentenced to three years’ jail. The sentences would run concurrently. In December 2013, Semitjie was convicted of reckless or negligent driving and failure to help an injured person after he skipped a red light and knocked Ferreira off his motorbike.
Ferreira, who was 18 at the time in November 2011, suffered head injuries and was comatose for weeks. Semitjie was driving then Gauteng housing MEC Humphrey Mmemezi to a meeting at the time.Khan said the sentence should be a deterrent for other road users who wanted to break the law.”Society and all road users should understand that traffic offenses are not petty offenses. They are criminal offenses just like murder, robbing and stealing.”
He said Ferreira would need therapy and medication for the rest of his life.Khan said the court was not convinced that Semitjie was remorseful.”You blamed everyone else except yourself. You blamed Ferreira, while you failed to ensure safety before entering a busy intersection. You failed to put on the siren and evidently, even as a trained police officer, you did not comply with the Traffic Act.”
Semitjie opted not to testify in his defence. “Your failure to testify left the court not knowing the true Joseph, leaving your fate to chance,” Khan added.(Stefanie) Blue light judge: Victim’s life destroyed Johannesburg – Krugersdorp Magistrate Abdul Khan has described blue light driver, Joseph Motsamai Semitjie, as having ‘destroyed’ the life of teenage victim Thomas Ferreira after hitting him with his car. “You entered a busy intersection without making sure it was safe to do so… you endangered the lives of others, and a young man’s life was destroyed. Alarm at high rate of police criminality in South Africa – SA Institute for Race Relations' Broken Blue Line Two reveals
AfriForum on 28 January 2015 released the Broken Blue Line Report, containing 100 examples of violent crimes in which South African police officers were involved since 2011. The report was compiled by the Institute of Race Relations (IRR).
AfriForum is of the view that National Police Commissioner, General Riah Phiyega is one of the main reasons behind the weakening of the South African Police Service (SAPS).
“The police no longer infiltrate gangs, but gangs infiltrate the police. How is it possible that one of every 100 police officers have a criminal record? The Broken Blue Line Report shows exactly why the police are failing in safeguarding the people of our country,” Ian Cameron, Head of Community Safety at AfriForum, said.
AfriForum proposed the following policy and other changes:
• General Phiyega should be replaced by a competent person.
• Minister of Police Nkosinathi Nhleko should be replaced.
• Transparency should be restored; the police should be seen as an honest institution again.
• Political appointments within the SAPS should end in order for service delivery to enjoy priority.
• The standard of training should be advanced.
• Specialist units should be revived without political interference.
• Criminal elements should be removed.
“The report shows that crime levels will not decline if wolf remains in sheep’s clothes. Private safety initiatives and structures are the only solution,” Cameron said.
• The report is the first of two knockouts by AfriForum against the police in the next two weeks. The civil rights organisation will release another report in February which indicates that government institutions have lost more firearms than licenced firearm owners.

Alarm at high rate of criminality in South African Police Service
January 26 2015 at 10:57am By Carlo Petersen Cape Town – Four years after a research report exposed alarming criminality within police ranks, fresh evidence from the South African Institute of Race Relations (SAIRR) shows that nothing much has changed.
The SAIRR risk analysis unit’s findings, which highlight criminal officers’ involvement in serious and violent crime, is set to be released in a research paper titled Broken Blue Line Two on Wednesday.
The Cape Times obtained an unedited draft copy on Sunday of the new report that details 100 crimes, including rapes and murders allegedly carried out by police officers from April 2011 to November last year.
In the SAIRR’s first report, the same was done for the period between January 2009 and April 2010.
When the 2011 report was released, police said the problem was ‘overstated’ and that measures were in place to deal with police criminality. And the police has again poured cold water on the new report.
The SAIRR then applied the same methodology for their 2015 report to test whether anything had changed.
— The 2011 report’s findings stated: “We found 40 cases related to murders. Rapes accounted for 20 incidents. Ten of the incidents related to armed robberies. Four cases implicate police officers in serious fraud, illegal dealing in weapons and ATM bombings.”
The findings for the 2015 report indicated 36 cases related to murders, 21 related to armed robberies, 27 related to rapes and 16 related to other types of crime ranging from torture to theft and burglaries.
“The fact that we could so easily identify 100 incidents over such a short period of time would suggest that South Africa continues to confront a massive problem,” the draft report states.
As solutions, the SAIRR makes proposals including restoring respect for the chain of command within the police.
“The choice of police commissioner in Riah Phiyega is so utterly inappropriate that it cannot instil confidence in other members.
“That such an important position can fall to such an incompetent person is indicative of the broader command and control problems facing policing in South Africa.”
In response, national police spokesman Solomon Makgale said on Sunday: “Criminality within the SAPS is not an invention of the national commissioner.
“Efforts are being put in place to reduce criminality within the police. Over the 18 months to October 2014, we dismissed 777 people.”
Makgale said Phiyega met SAIRR representatives on Friday.
“After questioning, it is being claimed that ‘no case dockets were studied, neither were court reports or judgments taken into consideration as part of this research,” he said.
Institute for Security Studies spokesman Gareth Newham also questioned the upper echelons of the police force.
“It is a challenge that must be addressed. There is no sense in appointing someone who does not know policing.”

Failures of justice system: Where is the justice for paraplegic Afrikaner Thys Henzen 43, raped and beaten in Welkom police cell?
Failures of justice system: Paraplegic Afrikaner Thys Henzen 43, raped in Welkom SAPS-cells: can’t afford ARVs to prevent AIDS…
10th February 2012 Thys Henzen, 43, paraplegic, was raped by a black detainee in Welkom police cells & beaten by cops during night of hell after a rough arrest by SAPS.
Mr Henzen was also kicked horribly by a police-boot and the cops emptied out three cans of teargas into his face:
2012-02-08 Volksblad journalist Tom de Wet interviewed the heart-broken Thys Henzen, 43, a paraplegic man who lives in a wheelchair and who told the journalist about his night of
hell in a Welkom police cell when he was helpless – and raped.
“I feel dirty, abused, humiliated. What does a man do with the rest of his life after such an ordeal?” he asked with eyes brimming with tears.
His ordeal started on 29 January 2012: he was roughly arrested that evening inside his own home, brutally assaulted, thrown into the police vehicle despite his physical frailty –
and a few hours later the totally helpless Afrikaner man was dragged from his wheelchair inside the SAPS-cells – and raped with considerable violence by a black detainee:
one man had held a blanket over his mouth while another sodomised him.
He has been examined and given a first round of antiretroviral medicine to prevent AIDS-transfer.
However – he cannot afford the entire course of medicines he would need to make sure he won’t end up with AIDS after his ordeal.
If anybody can help please email tdewet@volksblad.com.
He said it all started when a man whom the impoverished Afrikaner shares his home with, had invited friends over for a rowdy party.
Sometime during that night, Mr Henzen had cut his hand when he was seated in his wheelchair and had bumped against a railing with a glass in his hand. His hand then involuntarily jumped pushed upwards while still clutching the broken glass — and he then accidentially stabbed the arm of a man standing right night to him. The man wasn’t injured – but he got angered by the paraplegic man’s involuntarily mistake and phoned the police – lodging a complaint of assault. The police arrived very promptly: sprayed pepperspray in the helpless Afrikaner’s mouth, he was ripped out of his wheelchair and dragged to the front-garden and kicked – and then the badly disabled, frail Afrikaner was thrown into a police-van. They threw his wheel-chair in with him – so they knew he was disabled…
He was then driven around for quite a while in the van: the police even stopped alongside a darkened road at one point to beat him some more in the back of the van and also emptied out three cans of tear-gas on his face. Then they threw him in the Welkom police cells with harnened black criminals. At 3:30 one of the detainees dragged the disabled Afrikaner down to the floor, and muffled his screams with a dirty blanket across his mouth while a second man sodomised him. Only the next morning the traumatised Afrikaner man was found by SAPS station-commissioner brig. Mzondi Mojafi and col. Ben van Wyk. They arranged to take him with a special vehicle designed to carry paraplegics – to the court-room, where they asked for a postponement of his arraignment while they rushed him to hospital. At that point, the angered, unidentified party-goer had not yet dropped the charges… but during the course of the day, he did.
Henzen is terrified: he said he ‘thought about it for a week, thinking about whether he should tell his story to the news media and submit a charge against the SAPS.” “I am terrified of the police taking vengeance against me. I am totally helpless to defend myself if anything should happen. “And then this humiliation,’ he said…..

Failure of justice system: Where is the justice for paralysed Afrikaner youth Luday van der Merwe?
Failures of justice system: Has there been any justice for Afrikaner youth Luday van der Merwe, who was paralysed for life by the bullets of black gunmen on New Year’s Eve 2012 in Brits?
— the Trial of Zimbabwean accused Petrus Jamari Moyo 26 and Changeman Mathare 27 are being constantly ‘postponed’ by Brits magistrate’s court.
28 January 2015 — Whatever happened to the results of trial of the two black gunmen whose bullets paralised Afrikaans high school pupil Luday van der Merwe for life on New Year’s Eve 2012?
The investigating officer, South African Palice Service warrant-officer Moses Bushy Mmatli, has pushed for the trial at the Brits Magistrate’s court to be completed.
After yet another senselessly postponed court appearance on 5 May 2014 for the two Zimbabweans charged with ‘attempted murder’, Petrus Jamari Moyo 26 and Changeman Mathare 27, the dedicated police officer carried the frail, paralysed youth down the stairs of the law courts.
Luday is an important State witness in the trial. Luday became paralysed when the two black males allegedly shot him, and one of their bullets penetrated his spine and turned him into a paraplegic. When Luday saw them at court, he told the newspapers he ‘wanted to grab them both by the throat.
“Neither one could look me in the eyes,’ he reportedly said after the brief appearance in court. What happened to this trial?

Brits teenage hero faces paralysis after mugging
3 Jan 2013 – A TEENAGE boy is facing paralysis after his bravery saved a girl from being shot on New Year’s Eve. Luday van der Merwe will turn 16 tomorrow in the Dr George Mukhari hospital in Ga-Rankuwa. “He saved my life. He’s a hero. I was scared, but I’m alive because Luday pushed me out of the way,” a tearful Deidré Strydom (19) said yesterday.
Luday lives with his grandmother, Jenny Wallis, in Brits after his mother, a single parent, died of cancer last year. In 2007, he suffered brain damage in a car accident and had to learn to talk and walk again, with Wallis’s help.
Now, she said, doctors have told her he will be paralysed from the chest down after a mugger’s bullet lodged in his spinal cord. He was at the house of friends on New Year’s Eve when another guest became worried about her dogs, while crackers were being let off in the neighbourhood.
Luday, Strydom and her brother, Marcel (16), offered to walk down the street to check on the animals. “On the way back, three black men came up to us. One fired a shot in the air and then held the gun to my little brother’s head,” said Strydom.
“I pushed him away, but another man searched me for my cellphone.“When he turned away, I ran back towards Luday.”She was standing in front of him when the man pointed the firearm at her. “Luday turned me and pushed me out of the way. The bullet hit him.”The muggers fled and Marcel ran for help.“I held Luday’s head on my lap. My arms and clothes were full of his blood,” she said. The bullet penetrated Luday’s shoulder, went through his lung and lodged in his spinal cord. The party hosts rushed him to the Brits MediClinic, and he was later transferred to the Mukhari hospital for specialist care when X-rays showed the bullet lodged in his spine. Doctors told Wallis he will most probably be paralysed from the chest down, she said.
“His friends are crying so,” she said.“The girl blames herself, but it’s not her fault.” South Africa Today – South Africa News

Police criminality: City Press reveals that black township youths were told to attack, strip shops of foreigners and even helped
Exposé by City Press daily newspaper reveals that South African policeofficers had told black youths in townships of Soweto and West Rand to ‘strip foreigners’ shops and even helped’ — interviews with looters and with foreign shop-keepers victimized by ongoing looting and rioting of this past week.
http://www.citypress.co.za/news/cops-told-us-loot/
Soweto. 27 January 2015 – City Press Daily: “Police told us to strip foreigners’ shops and helped” says looters. More than 120 foreign shops were looted: and the victims confirmed the events described by the looters.
“The cops looked on and helped,’ victims say.
REPORT:
Foreign shop owners and those who took part in, or ¬witnessed, the looting of those shops this week described how police actively stole goods and helped others raid the shops during the worst attacks on foreigners South ¬Africa has seen in ¬seven years.
The rioting was widespread across the entire west rand region – but in suburbs of #Soweto and #Kagiso more than 120 foreign-owned shops were looted by organised mobs.
Foreigners have described how some police officers told them to “go back to where you come from”, ¬demanded bribes to do their jobs and helped themselves to goods on the shelves, including airtime and cooldrinks.
Widespread reports of criminal and xenophobic ¬behaviour by some police officers tasked with stopping the looting in Soweto fly in the face of statements made by ¬Gauteng police commissioner Joel Mothiba and Community Safety MEC Sizakele Nkosi-Malobane that what took place in Soweto during the course of the week was “criminal and not xenophobic”.
While looting was continuing in Soweto on Thursday, local cop Mothiba told a press conference that “the situation was “under control”.
On 26 January 2015 some ten young Soweto residents in different parts of the township openly admitted to taking part in the looting in interviews with City Press daily newspaper.
They told City Press that members of the South African Police Service had helped them do it.
Zondi residents Charlie Masondo and Tshepo Radiapeng told City Press that ‘they watched as police instructed looters to queue outside a foreign-owned shop and allowed four of them in at a time to prevent a stampede.
“I have never seen something like cops helping people to steal,” said Radiapeng. Masondo said he was shocked.
‘Steal but don’t vandalise the shops’ – police instructions:
“I was expecting the cops to stop the looters from stealing, but they allowed and organised them to do it. All they kept on saying was that people should not vandalise the shops,” he said.
A group of young people in Zola North township recounted how they looted the Sea Point general dealer in their neighbourhood.
“We took everything. This was a fully fledged shop. There was everything here. There were six double-door fridges used for soft drinks. We took everything.”
One said the police looked on while they looted. “They were actually helping us. They were driving a Nissan 1400 bakkie.
They actually came back to look for what might have remained on Friday.”
One of the other young men, who declined to be named, showed City Press one of fridges they had ¬looted. It has already been sold to a new owner.
Next to Sea Point, there is a shop owned by a South African. It was not plundered. All foreign-owned tuck shops in Zola North were closed this week.
Foreign shop owners to whom City Press spoke on Friday told of how, in some cases, police officers ¬refused to protect their shops, and instead helped those who were looting.
Somali shop owner Ismail Adam (29), who ran a shop in Slovoville, Soweto, said he and his brother hid in the toilet after looters struck at about 5pm on ¬Wednesday.
The police arrived later.
“I saw mamas come and the police gave them bread. I asked them why they gave away this bread [because it] is my money. They told me: ‘You are nothing, brother. Keep quiet – if you talk too much, I’ll give your stock away, all of it,’” said Adam.
“Even other police, I saw them come in the shops. They took Grandpa headache powder and airtime – everything. When we left, they said: ‘My friend, come here. Give us money for cool drink.’ I said I didn’t have money. They told me that if I didn’t give them money, they would leave. I gave him R200.
“There were five police cars. When the police were there, people were stealing. Police were standing there watching.”
Shukri Abdullahi (42), a shopkeeper in Meadowlands, Soweto, said looters assaulted her at the entrance to her shop in front of the police, who did nothing.
“When I asked for assistance, the police said I can go back to where I come from. There were a lot of people and they beat me up – the police did nothing.”
Fatima Hasan (27), whose brothers ran a shop in Slovoville, which was looted on Wednesday night, went to help them the next morning.
“I fell and hurt my leg because I ended up running away. The police abuse us because we are foreigners, they tell us to go away. They tell me: ‘You come here to make money in our South Africa.’ This is the fifth time this is happening to me, what can we do now? Even when we go to the clinic, sometimes they tell us to go back to our country.”
At an urgent meeting between Gauteng Premier David Makhura and foreign shop owners, which was attended by Gauteng Transport MEC Ismail Vadi, in Mayfair, Johannesburg, yesterday, Makhura reiterated the government line that this week’s action was “criminal and not xenophobic”.
He also assured shop owners that government and the police would do all they could to protect them and stop the anarchy.
“The indiscriminate looting in the shops is something we have condemned. We have told the police to find the looters, and already 160 people have been arrested,” Makhura said.
“What we saw in Soweto was not xenophobia, but criminal activity. And crime must be dealt with as crime because crime has no colour, class or gender.”
This week, a police officer was filmed apparently participating in looting in Dobsonville, Soweto.
City Press has learnt that a multidisciplinary task team, made up of the police’s tactical response team, public order policing units, detectives, crime intelligence and visible policing units has been established to find the instigators behind the unrest (see page 6).
Police spokesperson Solomon Makgale said on Friday night that a 13-month-old baby was trampled to death by looters in Kagiso.
“While people were looting one spaza shop, police arrived. The looters scattered. As they fled, some ran into a woman in her early 20s carrying a baby. In that commotion, the baby fell and was trampled by the fleeing mob. A case of murder is being investigated by Kagiso detectives,” he said.
In response to allegations of police collusion in the looting, Makgale said they knew of one case and had “taken the appropriate action in response”.
“There is absolutely nothing of this sort that has been brought to our attention. If there is evidence to corroborate these allegations, then we will certainly look into them and take action.”
Makgale said it was a pity that City Press decided to report a story containing “wild allegations” with “no shred of evidence”.
“Just because one police officer was shown on video looting, it does not mean every police officer who was out there was involved. If this story is published, then it will go down as the worst form of journalism I have ever seen,” he said.
Meanwhile, SA Spaza & Tuckshop Association president Rose Nkosi, whose organisation represents more than 3 000 stores around the country, said government should use the eviction of foreigners from Soweto as an opportunity to create jobs for local unemployed youth.
“These people are given spaces, but locals don’t have good places to sell. How do foreigners get good spots? That’s my first question, because we have officials at the border gates. How are these people coming in just like this?” she said at the home of 14-year-old Mthetheleli Mahori, whose death on Monday sparked the looting.
“We don’t want them back here, and the community has spoken. Rather let them go back to their countries and leave our country with freedom.”
Nkosi insisted that the spaza shops will reopen, “but only South Africans should run them”.
Meanwhile, City Press saw three elderly women begging police to allow them to buy bread for R9 as heavily armed police guarded a shop in Diepkloof.
One of the women, Victoria Mbambo, said she could not afford food from big retail shops because spazas sold cheaper goods.
“I know I will go hungry. Many others will go hungry. People do not think about tomorrow, they just think of today and come next week, they will be hungry and there won’t be anybody to give you food on credit like these people have been doing for years. That’s how many of us survive. What are we going to do now?”
